In these terms and conditions, the words "website" refers to The OCPD Foundation website, "we", "us", "our" and "The OCPD Foundation" refers to The OCPD Foundation and "user", "you" and “your" refers to you, the user of The OCPD Foundation.

The following terms and conditions apply to the website offered by The OCPD Foundation. This includes the mobile and tablet versions as well as any other version of The OCPD Foundation accessible via desktop, mobile, tablet, social media or other devices.

1. ACCEPTANCE OF TERMS

This agreement sets forth legally binding terms for your use of The OCPD Foundation. By using the website, you agree to be bound by this agreement. If you do not agree to the terms of this agreement, you must not use the website. We may modify this agreement from time to time, and such modification shall be effective upon posting on the website. You agree to be bound by any modifications to these terms and conditions when you use the website after such modification is posted on the website; therefore, it is important that you review this agreement regularly.

The website is available for all ages. It is the responsibility of parents and legal guardians to determine whether use of the website or any of the content available on the website is appropriate for their child or ward.

The OCPD Foundation may, in its sole discretion, refuse to offer the website to any entity or user and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the service and the website is revoked in such jurisdictions.

By using the website, you represent and warrant that you have the full right, power and authority to enter into this agreement and to fully perform all of your obligations hereunder. You further represent and warrant that you are under no legal disability or contractual restriction that prevents you from entering into this agreement.

2. NEWSLETTER

By providing The OCPD Foundation with your email address, you agree that we may use your email address to send you important notifications and communications about our organization, news and special content. If you do not wish to receive these emails, you may opt-out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in the emails themselves. This option may prevent you from receiving emails about our organization, important news and special content.

3. DONATIONS

We appreciate your interest in supporting our mission to provide help to people coping with obsessive-compulsive disorder (OCD), advance research in this field, and decrease the stigma associated with mental illness. Your contribution is critical to achieving these goals and making a positive impact on the lives of those struggling with OCD and similar conditions.

All donations received through our website will be used exclusively to fund projects and activities related to our mission. This includes, but is not limited to:

Supporting People with OCD: Funds raised will be used to provide resources, support services and accessible treatment programs to those affected by obsessive-compulsive disorder. We seek to improve their quality of life and provide them with tools to effectively manage their condition.

Research: Your generosity will support research studies focused on better understanding the biological, psychological and social aspects of OCD. By making a donation through our website, you agree and understand that your funds will be allocated according to the above principles.

Please note that because the organization operates as an LLC and NOT a 501(c)(3) organization, your donation will not be tax deductible.

4. SHOPPING ON THE WEBSITE (MERCHANDISE)

Users will be able to purchase merchandise on the website. By placing an order, you offer to purchase the products for the price advertised and indicated on the website at the time of purchase. Please check the specifications and variants of the products before placing your order.

When a user places an order, the OCPD Foundation will send an email in order to confirm the purchase and payment. This confirmation email will be produced automatically so that the user has confirmation of their purchase and order details.

We reserve the right to limit the number of units purchased by each user. The OCPD Foundation also reserves the right to limit sales of our products by region or jurisdiction.

The OCPD Foundation may cancel any order and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an order is cancelled, payments made for the products will be refunded in full. This does not affect your statutory rights.

All new orders are considered separately and are treated individually.

5. MEMBERSHIP

We appreciate your interest in joining our community dedicated to promoting excellence in the delivery of therapeutic services and advancement in the field of mental health. Below are important details about your annual membership:

Benefits of Membership: By becoming a member of our organization, you will have access to a variety of benefits designed to support your professional development and strengthen your therapeutic skills. These benefits may include, but are not limited to:

  • Access to exclusive resources, such as educational materials, research and clinical tools.

  • Participation in events, workshops and conferences organized by our organization.

  • Networking opportunities with other therapists and professionals in the mental health field.

Annual Dues: Membership in our organization requires the payment of an annual fee. This fee contributes to the maintenance of the services and resources we offer to our members, as well as to the continued support of our organization's mission in the field of mental health.

Membership Renewal: Your membership will automatically renew each year unless you choose to cancel it with advance notice before the expiration date. We will send you timely reminders to inform you about the renewal date and the steps to follow to continue being part of our community.

Membership Cancellation: If you decide to cancel your membership, we ask that you do so before the expiration date to avoid automatic renewal and the corresponding charge. No refunds will be given for membership periods that have already begun.

Responsible Use of Resources: By accessing resources and participating in events provided by our organization, you agree to use them in an ethical and professional manner. We respect the confidentiality of shared information and expect all members to do the same.

6. PAYMENTS

Products, donations and membership fees will be paid by the following payment methods:

  • Credit/debit card (Visa, Mastercard, Discover, Amex, Diners, etc.)

  • PayPal

Payments will be processed through our payment processors Stripe and PayPal. The user must pay the price of the product stipulated in the order before the product is shipped. Payment will be charged to the user's credit/debit card or PayPal account immediately after placing the order for the product(s) purchased. In the case of therapist memberships, the fee will be billed annually on each billing date. Donations will be charged during the donation process on the website. Once the transaction is processed, we will send an electronic receipt of the transaction to the user's email address.

If you find any inconsistency in your billing, please contact us through our contact information or you can make the claim through the customer service of the corresponding payment processor.

If your card is declined, you will receive an error message. No payment will be charged to your card and no order will be processed. There may be a pending transaction on your account until your card issuing bank withdraws the authorization. This usually takes 2 to 5 business days. Your card may be declined for various reasons such as insufficient funds, AVS (Address Verification System) mismatch or you have entered an incorrect security code.

If your payment is declined, you must provide an alternative payment method or provide another card where payment can be charged and processed.

Your payment information will be treated and kept with total security and with the exclusive purpose of processing the purchase of products, donations and membership fee for therapists. The OCPD Foundation reserves the right to contract any payment processor available in the market.

7. LIMITATION OF LIABILITY

The information contained in our website is for purely informational and educational purposes. It should not be construed as a definitive medical or psychological diagnosis. It is intended to provide general knowledge about OCD and suggestions for managing symptoms effectively.

Subject as aforesaid, to the maximum extent permitted by law, The OCPD Foundation excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to The OCPD Foundation and The OCPD Foundation shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

  • Any incorrect or inaccurate information on the website.

  • The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website.

  • Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

The user agrees that any dispute, claim or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation or validity thereof or the use of the website, shall be resolved by binding arbitration between the user and The OCPD Foundation, provided that each party retains the right to bring an individual action in a court of competent jurisdiction.

In the event of a dispute arising in connection with the use of the website or the breach of these conditions, the parties agree to submit their dispute to arbitration resolution before a reputable arbitration organization as mutually agreed by the parties and in accordance with applicable commercial arbitration rules.
